Issue: 영주권을 포기할 경우 반드시 미국국세청에 보고해야 하는가?

 

Answer: YES. 반드시 미국국세청에 소정의 양식으로 보고해야 한다.

 

Legal Conclusion:

"시민권포기자(Renouncing US Citizen)와 8년 이상된 영주권포기자(Long-Term Lawful Permanent Resident or LLPR or LTR)는 이유 불문하고 미국국세청(US Internal Revenue Service)에 보고할 의무가 있다. 따라서, 영주권포기자의 경우 영주권포기신청서 USCIS Form I-407을 제출할 때, 반드시 IRS Form 8854를 미국국세청에 작성/제출하여야 한다. 이 서류를 제출하지 않으면, 국적포기세 납세요건에 상관없이 무조건 납세의무자(Covered Expatriate)가 되어, 국적포기세 납세의무가 생기고, 최악의 경우 조세포탈에 연루될 수 있다."

International Revenue Code (IRC) 877 와 IRS Notice 2009-85

 I.R.C. Section 877 (a) (2) (C)

 “such individual fails to certify under penalty of perjury that he has met the                                              requirements of this title for the 5 preceding taxable years or fails to submit such                                  evidence of such compliance as the Secretary may require.”

 

영주권포기자가 국적포기세 납세의무자(Covered Expatriate, 이하 CE)가 되는 3가지 요건중 1) 지난 5년간 평균수입과 2) 자산 200만불 이상이면 CE가 되어 국적포기세 납부의무가 생긴다는 것은 많이 알려져 있지만, 3번째 요건에 대해서는 명확한 설명이 없었다. 이유는 3번째 요건이 지난 5년간 세금의무를 성실히 수행했다는 "증명" 을 해야 한다고 말하고 있는데, 명확히 어떻게 증명해야 하는지에 대한 설명이 없었기 때문에, 전문변호사들도 이부분을 간과해 왔다고 생각한다.

 

일종의 미국국세청 내부법령해석집인 IRS Notice에 이해 대해 명확히 기술해 놓았다. 즉, 위 증명을 위해서 IRS Form 8854를 반드시(Must) 제출해야 한다는 것이다. 원문은 아래와 같다.

 

Section 8C of the IRS Notice 2009-85  

“All U.S. citizens who relinquish their U.S. citizenship and all long-term residents who cease to be lawful permanent residents of the United States (within the meaning of [IRC] Sec.7701(b)(6) must file Form 8854 in order to certify, under penalties of perjury, that they have been in compliance with all federal tax laws during the five years preceding the year of expatriation. Individuals who fail to make such certification will be treated as covered expatriates within the meaning of section 877A (g) whether or not they also meet the tax liability test or the net worth test. 

 

위 두개의 legal authority를 합해서 해석해 보면 (굵은 글자로 표시된 곳만 모아서 읽어보면 의미가 명확해 진다.) -->  모든 미국시민권 (또는 8년 이상된 영주권 포기자)는 이유 불문하고 Form 8854를 file해야 하고, Form 8854가 IRC 877에서 말하는 증명 즉, certification역할을 한다는 결론에 도달한다.
